Definitive duty on thermal sensitive paper mooted

NEW DELHI, March 7

THE Designated Authority in the Commerce Ministry has recommended definitive duty on imported thermal sensitive paper from Japan and the European Union (EU).

In its final findings to be gazetted, the Authority has said that thermal sensitive paper (TSP) originating in or exported from the EU and Japan has been exported to India below its normal value and the domestic industry has suffered material injury. TSP is primarily used in the fax machines, ECG machines, cash registers, CAD/CAM registers. No anti-dumping duty has been recommended by the Authority on the imports of TSP from Finland as there was no import of TSP into India form Finland during the period of investigation.

Confirming its preliminary findings on the imposition of anti-dumping duty and recommending imposition of anti-dumping duty on all imports of TSP falling under Chapter 48 of the Customs Tariff Act, originating in or exported from Japan and the EU the ant i-dumping duty would be Rs. 1.61 per sq.m in the case of EU, and Mitsubishi HITEC and others it is Rs. 1.84 per sq.m. In the case of all other exporters and exporters from Japan it is Rs. 1.62 per sq.m.

It was held in the preliminary findings that the petition has been filed by Shree Krishna Paper Mills and Industries Ltd and is the sole producer of the subject goods.

The Authority said that it received a reference from the Delegation of European Union office stating that as per the WTO agreement on anti-dumping, the Authority is required to disclose essential facts under consideration which forms the basis of final f indings.

The Authority said that it disclosed the essential facts including relevant issues/arguments raised by interested parties.

Dumping probe on hydroxyl amine sulphate from US, Japan and EU initiated: The Designated Authority in the Commerce Ministry has initiated anti-dumping investigations on the alleged dumping of Hydroxyl Amine Sulphate (HAS) from the US, Japan and the Europ ean Union (EU).

In its initiation notification, the Authority held that various parameters relating to injury such as suppressed domestic price, decline in sales volume, lost contracts and reduction in profitability, etc prima-facie indicate collectively and cumulativel y that `domestic industry' has suffered `material injury' on account of dumping.

While noting that there is sufficient prima-facie evidence that normal value of HAS in these countries (US, Japan and EU) are higher than the export price to India, the Authority held that this prima-facie indicated that HAS is being dumped by exporters from these countries.

The petition seeking anti-dumping investigations has been filed by Deepak Nitrite Ltd (DNL), the sole producer of HAS in India. The period of investigation for the present investigation is from July 1, 1999 to December 31, 1999.

The Authority held that the petitioner's request to initiate investigations cumulatively against EU has been accepted as DNL had provided ``specific prima-facie'' evidence in case of the Germany, UK and Netherlands and claimed that member countries of Eu ropean Union are having common customs territory, with no customs barriers.
