A Supreme Court bench today refused to interfere in the Lanco Hills case where the Wakf Board sought to restrain the company from selling properties claiming that it was their land.
The Court, in its earlier order, had permitted Lanco Hills to sell the properties in the project subject to final outcome.
Wakf Board
The order was passed on an application filed by Wakf Board seeking a direction to restrain Lanco Hills from alienating the properties. The matter came up before the bench headed by Justice Lodha and Justice Lokur.
However, the Court has clarified that Lanco Hills will inform the prospective customers about the pendency of the matter in the Supreme Court.
There is no restriction on Lanco Hills to construct, sell, transfer or lease out the properties in the project.
The Apex Court in its order on May 8, 2012, had removed all hurdles for Lanco Hills towards the development of the entire project.
The Supreme Court had then stayed the orders passed by Wakf Tribunal and Division Bench of Hyderabad High Court which stopped Lanco Hills from selling the properties to third parties.
The Supreme Court ruled that in the event the title dispute pending in the court between State Government of Andhra Pradesh and Wakf Board is ultimately decided in favour of the Wakf Board, then the State can compensate Wakf Board either monetarily or by providing alternative land.
Township planned
Lanco is developing a 100-acre integrated Lanco Hills township in Hyderabad.
The residential towers under Phase I and IT Tower of 0.64 million sq ft are ready for occupation.
