The ongoing inquiry of the criminal complaint against Lavasa Corporation in a Pune court was deferred to November 17 to enable complainant Maharashtra Pollution Control Board (MPCB) to file documents to prove that non-executive directors were liable for prosecution.
The Chief Judicial Magistrate, Ms N.T. Ghadge, asked MPCB to provide documents to support their claim that nine non-executive directors who have been named in the case were also responsible for the acts of the company, and hence could be prosecuted.
The Court has also directed the MBCB to produce the original file of Lavasa seeking NOC from the environment ministry of Maharashtra to begin construction in 2004 and the correspondence there on.
On November 3, the MBCB had filed criminal proceedings in the Pune court against Lavasa Corporation represented by Chairman Ajit Gulabchand, directors Anuradha Desai, Aniruddha Deshpande, Gautam Thapar, power of attorney holder Vithal Maniyar and 11 other officials.
