The Chandigarh Bench of the National Company Law Tribunal (NCLT) on Monday issued notice to Omaxe and its Chairman Rohtas Goel, restraining Guild Builders — the holding company of Omaxe — from pledging any more shares of Omaxe for taking loans for Omaxe or any of its subsidiaries.
The statement said that Omaxe was borrowing from various financial institutions/ banks/NBFCs by pledging Omaxe shares which are held and controlled by Guild.
This order is a major victory for Sunil Goel, second largest promoter-shareholder and former Joint Managing Director of Omaxe who has filed a petition of financial fraud and mismanagement in Omaxe by his elder brother Rohtas Goel. In the recent past two of the three independent directors resigned from Omaxe after the filing of this petition.
The statement added that the tribunal also allowed Sunil Goel and his team to inspect the records of the company.
The next hearing of the case by the NCLT Bench is scheduled for February 20.
