Company directors who fail to file their annual e-KYC form will now have to pay ₹ 5,000 fees, said the Corporate Affairs Ministry (MCA).₹₹
MCA on Friday notified about the new annual form - DIR-3 KYC and also specified late fee of ₹ 5,000 for delayed forms.
In the case of current financial year 2018-19, no fee would be chargeable till August 31, 2018 and fee of ₹ 5,000 would be payable on or after September 1, 2018, the MCA said on Friday.
For directors who had been allotted Director Identification Number (DIN) on or before March 31, 2018 and whose ‘DIN’ is in ‘approved’ status, the MCA had stipulated that they would have to file form DIR-3 KYC on or before August 31 this year.
Filing of DIR-3 KYC would be mandatory for disqualified directors also, the MCA had said.
After expiry of the due date by which the e-KYC form is to be filed, the MCA-21 system will mark all approved DINs (allotted on or before March 31, 2018) against which DIR-3 KYC forms have not been filed as 'deactivated' with reason as 'non-filing of DIR-3 KYC'.
The MCA has now amended its rules to empower the Centre or Regional Director (Northern Region) or any officer authorised by them to deactivate the DIN of an individual who does not intimate his particulars in e-KYC form within the stipulated time.
After the due date, filing of DIR-3 KYC in respect of such deactivated DINs would be allowed upon payment of a specified fee, which has now been specified as ₹ 5,000.
