Railways will not pay compensation for the accidents caused due to carelessness and negligence on the part of travelling passengers.
A Bill seeking to ring-fence Railways' liability on the matter of awarding compensation for “accidental falling” of any passenger from a train was introduced in the Lok Sabha here on Thursday.
While the Railways will compensate a passenger for injuries or to his dependent in case of death — in an incident of accidental falling, it will not fork out monies where the accident was caused due to carelessness and negligence on the part of travelling passengers.
Through this proposal in the Railways (Amendment) Bill 2014 — introduced by Railways Minister Sadananda Gowda —, the loss to the exchequer is sought to be avoided.
The Bill also provides for Railways under whose jurisdiction the loss or injury has occurred to be made a party before the Railways Claims Tribunal. This will help tackle the menace of false claims by the claimants causing loss to the exchequer.
Through the proposed law, the filing of duplicate claims — by making different railways as party for the same claim — could be avoided.
Also, the settlement of compensation in train accidents and untoward incidents where there is a fault on the part of Railways will be expedited.
