The Delhi High Court on Wednesday rejected the bail application of DMK MP, Ms Kanimozhi, and Kalaignar TV Managing Director, Mr Sharad Kumar, both accused in the 2G spectrum case. This would mean that they will remain in Tihar jail for some more time.

Dismissing their bail plea, Mr Justice Ajit Bharihoke observed: “The Petitioner (Kanimozhi) belongs to the same political party to which accused (former Telecom Minister and accused in the 2G case) Mr A. Raja belongs and the said party is sharing power in the Central Government.”

The judge added that considering the financial and political clout of Ms Kanimozhi and Mr Kumar, a possibility cannot be ruled out that if they are freed at this stage, they would interfere with the investigation or try to influence the witnesses. The CBI had accused the duo of taking bribe of Rs 200 crore as “reward for undue favours” shown by Mr Raja in the 2G licence allocation to Swan Telecom in connivance of other public servants. They were arrested on May 20 after the Special Court turned down their bail application.

Noting the facts and circumstances of the case, the High Court, said prima facie it shows “the complicity of the petitioners in the conspiracy and their having received illegal gratification of Rs 200 crore in the account of the company controlled by them, namely Kalaignar T.V. Pvt. Ltd.”

It pointed out that the proximity of dates on which the money got transferred via circuitous route involving DB Realty Group Companies, Kusegaon Fruits and Vegetables Pvt Ltd, and Cineyug Films Pvt Ltd as also the reverse trail of money, prima facie, cannot be a coincidence.
