IT employees in Tamil Nadu are free to form trade unions and can redress grievances through evoking provisions of Industrial Disputes Act 1947, according to the State Labour and Employment Department.
In a letter to organisers of Puthiya Jananayaga Thozhilalar Munnani, the department said no IT industry has been exempted from provisions of Industrial Disputes Act 1947. Affected employees can approach the conciliation officers to redress problems regarding retrenchment, termination, or any other grievance.
Any trade union with IT employees as its members can raise industrial disputes under Section 2(k) of the Act and seek remedy. The IT industry comes under Shops and Commercial Establishments Act. However, in any industry, including service or hospitality, if there will be dispute and everybody comes under Industrial Disputes Act, said a government official.
