Matrimony.com has obtained an interim injunction from the Madras High Court against Kalyan Matrimony, owned by Kalyan Jewellers, and others for infringement of its trademarks through the Google Adwords Programme and in Search Engine Optimisation (SEO).
It has also obtained interim injunction against a few other ‘violators’ who have domain names similar to the trademarks of Matrimony.com brands — Tamil Matrimony, Telugu Matrimony, Kerala Matrimony and Kannada Matrimony in the order passed by Justice S Vaidhyanathan on April 16.
The injunctions have been obtained against Bharatmatrimony.org, reddytelugumatrimony.com, telugumatrimony.org, vanjaritelugumatrimony.com, snkeralamatrimony.com, alltelugumatrimony.com as well as the mobile application Bharatcommunitymatrimony, says a press release from Matrimony.com
Some matrimony service providers are trying to create confusion in the minds of people by misusing trademarks of Matrimony.com in their domain name, descriptions on their websites, in Google SEO and Search Engine Marketing and on the App Store, it said.
“We are pursuing legal action against those who deceptively use names similar to our trademarks and attempt to ride on the goodwill and the reputation of our long standing brands, on which we have invested heavily over the past two decades,” S Ravichandran, GM-Legal & Regulatory at Matrimony.com, said in the release. A spokesperson for Kalyan Matrimony said that the contention of infringement is ‘vehemently denied’.
Matrimony.com had earlier sent a legal notice alleging infringement, which was replied to in detail setting forth the facts. It appears that despite that Matrimony.com have chosen to file the present proceedings and take an interim injunction. The same shall be defended by Kalyan Matrimony, the spokesperson said.
