The Delhi High Court today sent Bollywood actor Rajpal Yadav to 10 days in jail for misleading the court in a recovery suit filed against him and his wife by a businessman here.
The court also detained his wife Radha Yadav, who was carrying their infant, till the rising of the court.
Yadav and his wife, along with their child, appeared before Justice S Muralidhar, who had directed them to appear in-person as they had failed to appear in the court earlier.
The court, which was hearing the suit, took exception to the affidavit filed by Yadav yesterday, which was an allegedly falsely prepared and contained forged signature of his wife.
Annoyed over the attempt of the actor, the court ordered that he be sent to 10 days in jail and also directed that his wife be kept in the office of the Registrar General till rising of the court.
“10 days simple imprisonment for Yadav. As far as respondent number 3 (Yadav’s wife) is concerned, the court is taking a lenient view as she has a child with her. She will be kept in the room of Registrar General till closing of the office (today),” Justice Murlidhar said.
Rajpal and Radha have been engaged in a legal battle after Delhi-based businessman, M.G Agarwal (owner of Murli Projects), filed a case against them in the High Court for failing to repay a loan of Rs 5 crore which the actor had taken in 2010 to make his Hindi debut directional film ‘Ata Pata Laapata’.
The court, meanwhile, also ordered the advocate representing Yadav and Radha to leave the case and issued contempt notice to the oath commissioner who had allegedly prepared the false affidavit.
Soon after passing the order, Yadav and his wife were taken into custody, on which the court directed the officer who was taking away Radha to give all the facilities to her, saying she will remain in the custody till the rising of the court.
Reacting to the court’s order, Yadav told the judge that this was the first case of his life and pleaded that he should be given a chance. He also said the businessman should get money and today also “I am ready to give it”.
The court posted the matter for January 15, 2014 for further proceedings.
The court had earlier noted that the couple had repeatedly breached the undertakings given by them to repay the loan amount.
As the couple failed to give a firm undertaking on whether they were prepared to pay the entire outstanding amount, the court had asked them to remain present in court on the next hearing.
On court’s directions, Yadav had yesterday appeared before the court while his wife had failed to turn up.
