Bengal to move division bench against panchayat poll order

The West Bengal Government will appeal to a Division Bench on Monday against the order of a single judge Bench of the Calcutta High Court regarding the panchayat polls.

On Friday, Justice Biswanath Somadder had directed that panchyat polls should be held in three phases and with the support of central paramilitary forces as demanded by the State Election Commission.

Stay order

Following a meeting with Advocate General Bimal Chatterjee on Sunday evening, State Panchayat Minister Subrata Mukherjee said the Government would move the Division Bench seeking a stay order on the single judge bench’s judgement.

“Law minister and I discussed with the Advocate General how to go about moving the Division Bench,” Mukherjee told reporters.

The Panchayat Minister told a news channel that election could only be held after October (after Durga Puja) given the current situation.

According to him, the State Government might issue an ordinance in case of a “constitutional crisis” if the elections are not held before the tenure of the rural bodies ends in June.
