Ghaziabad’s Sun Tower residents’ welfare association is expecting to get back their open green area in the complex after the Allahabad High Court recently ordered the Ghaziabad Development Authority (GDA) to not issue completion certificate to Saya Gold Avenue.
“The 37-storey building is constructed on the area marked for park in sanctioned plan of 2005. After the May 14 order of the Allahabad High court we are hopeful to get our green area back ”, Lakhmi Chand, General Secretary, Sun Tower residents’ welfare association said at a press conference.
The statement issued by the RWA said that Shipra builder allegedly sold its Floor Air Ratio (FAR) to Saya builder and it covered entire land and built eight towers (each tower being 3 basement+37 storey) leaving no land for green area and did not seek mandatory consent of the RWA as per the law.
The association has filed a writ petition against GDA, Saya and Shipra builders alleging violation of FAR and construction on park.
“It was in 2015 that we first knocked the doors of Allahabad High Court but at that point, it did not entertain our petition. Later we approached the Supreme Court which directed the matter to Allahabad High Court and appointed the three member court commission in 2017”, says Chand.
The association members also said that they were made to live in incomplete Sun Tower buildings for past 12 years without open area for fresh air and sunlight by GDA and Shipra builder.
